Thailand Introduces New Electronic Trademark Registration Certificates under the Madrid Protocol
The Thai Department of Intellectual Property (DIP) has announced a significant update to the issuance of trademark registration certificates for international registrations under the Madrid Protocol. Effective 15 August 2025, all certificates will now be issued as electronic certificates, reflecting DIP’s commitment to modernizing services, improving efficiency, and providing greater convenience to businesses and the public.
This new electronic format replaces the previous certificate format under the 2024 announcement (B.E. 2567) and is issued in accordance with the Ministerial Regulations under the Trademark Act B.E. 2534 Section 33, as well as prior DIP notifications regarding the Madrid Protocol.
Key Features of the New Certificates
- Each certificate can be verified by scanning the QR code on the document, which provides direct access to the electronic records in the DIP system.
- The certificates are fully legally recognized under Section 43 of the Thai Trademark Act B.E. 2534 (as amended) and carry the same enforceability as traditional paper certificates.
How Certificates Are Delivered
Owners of trademarks under the Madrid Protocol will receive electronic certificates (CM 1–CM 3) complete with QR codes, together with:
- Madrid Protocol Model Form 4 (MF4): Statement of Grant of Protection, or
- Madrid Protocol Model Form 5 (MF5): Statement of Total or Partial Grant of Protection following a provisional refusal.
Certificates and supporting documents are sent via WIPO, and the registration details are reflected on the Madrid Monitor system (https://www3.wipo.int/madrid/monitor/en/) and DIP IP Search system (https://search.ipthailand.go.th/).
Digital Signatures for Security and Authenticity
All electronic certificates are signed digitally using Public Key Infrastructure (PKI) technology. This ensures the integrity of the information and protects against any unauthorized alterations. The digital signature has the same legal effect as a handwritten signature on paper, in line with the Electronic Transactions Act B.E. 2544 (as amended).
This update enables trademark owners to access, verify, and utilize their registration certificates with greater efficiency and security, while maintaining full legal protection for their trademark in Thailand.
